Pre Trial Diversion/Intervention??????

I was arrested back in 1999 for Assault Causing bodily injury family violence. This was my first offense ever. I was giving pre trial diversion. I completed the program and my case was dismissed. Will I qualify for the chl in texas.

It is my understanding that the pretrial diversion program in Texas can result in NO conviction on the record. However you will have to review the paperwork for your particular case.

All i need now is to take the class on Sept. 11, 2011 and send the paper work in. I've been wanting to get the chl for a while but i thought I had received differed adjudication. I went to a lawyer to get my record expunged so that i could get a chl and we found out that i was giving pre trial diversion (PTD). Anyways he said PTD and differed adjudication are two different things. Im just worried of losing about $330 if it falls through and im denied a chl. Thanks

It might be worth a call to the CHL division in Austin. They might be able to provide a little more information.

AN easy way to find out is to try to buy a gun from a licensed dealer

If the sale goes thru then you are probably ok

If sale is deny than forget the CHL and get a lawyer and try to get the record fixex

OK, so i took the chl class sent my paper work and background completed. Now pending manufacturing!!! I don't think my criminal record made it take any longer than anybody else. Really happy. El Paso, TX

9/27/11: First online Status
10/11/11: Background Check complete
10/11/11: Pending Manufacturing: :) !!!!!
10/12/11: Manufacturing
10/13/11: Mailed
10/19/11: plastic on Hand!!!

Just curious, did you list it as a prior arrest on your application? I have the same thing - prior, with deferred adjudication and ultimately sealed record. By law, I can omit the fact that I was ever arrested, but I don't want to play the semantic game and delay the process if I don't need to. Just wondering how complete their records are - would they be able to see sealed records?

I've seen both options recommended on this forum - declare everything, or stick to the letter of the law which says I wouldn't have to declare.
