Anything I can do?

My BIL bought a rifle and it has been received at his FFL. Apparently the NICS is so backed up that his approval is delayed. I chuckled a little and said this wouldn't be a problem if he had his CHL. He said the FFL guy asked if he had a CHL and they wouldn't have to wait for the NICS.

Is there anything I can do or would that just cause problems?
I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.

The delays are not uncommon right now, we are seeing more delays than ever before, most of them have received a "proceed" within 2 days. Just let it run it's own course. Going and getting the rifle for him could very well be construed as a straw purchase to circumvent his delayed status. I expect to see the Fed's try to make an example out of people since they are being hammered for not enforcing the laws on the books.

I figured it was a no-no. He didn't ask and I didn't offer. It'll be fine. Other than buying the rifle in the first place and ticking my sister off, he hasn't done anything wrong in at least 30 years and nothing that would disqualify him anyway.

You could recommend a CHL instructor to him.

Yeah, I told him we would have to get that taken care of so this wouldn't be a problem in the future.

You mean to say the government is inefficient? No way. I'm not buying it. I mean, they want to add an additional 40% of purchases in there.

This stuff ticks me off. Should be you are either immediately approved or denied for a disqualifying event. The delay stuff is a crock.

I have never had a first hand "class" on how the NICS works, but I doubt it has anything to do with being "backed up". The checks are done electronically and the majority of mine go through within 30 seconds. When they run the info and some potential problems turn up it is delayed for further investigation. Here is an excerpt from the NICS page:
"The majority of NICS checks are determined within minutes, sometimes seconds, after the background check search is initiated. If the NICS does not match any records in the databases searched, the FFL is advised the firearm transfer may proceed. If the search yields a valid match to prohibiting information, the FFL is advised to deny the transfer of the firearm.

If the search is matched to any potentially prohibiting records, the NICS Section must reach out to judicial and/or law enforcement agencies for the information needed to render a final decision. The Brady Act allows three business days for this purpose. If the information is not obtained within the three-business-day time frame and a final decision of proceed or deny is not made, the FFL has the option to legally transfer the firearm."

We'll see. His FFL told him he's been getting several delays lately and had about 14 waiting at this time. I don't know who his FFL is, but my BIL hasn't bought a gun in over 20 years so it's not someone he's known very long.

In the last 2.5 years I have had only about 5 delays. I have had one in the last two months so nothing extra on my side but I suppose if something comes up that needs reviewed/looked at closer that would take longer now.

Would you think it could be something the FFL is doing strange? I'm sure plenty are doing quite a few background checks lately and there may be other reasons that they would focus on the activity of one more than another. I hope that is not the case with this one.

:iagree: with what the others have said... but I suggest you take a look at BATF Form 4473 question 11.a. If you answer honestly -which I don't doubt you do- you'll need to answer that in the negative... as you are really buying the gun for someone else (your BIL).

I have entered wrong info once and it caused a delay. Every time I get a delay I look over all the info I entered, the one time I found a mistake I called the NICS and told them. They had me re-run the NICS check and it went through. Other than that I do not think it is anything the FFL would do.
