Are airguns "firearms" according to Texas?

Post by nitrogen »

§ 46.01 (3) seems to say, "no":

(3) "Firearm" means any device designed, made, or
adapted to expel a projectile through a barrel by using the energy
generated by an explosion or burning substance or any device
readily convertible to that use. ...

Am I missing anything? What say the experts?

No an airgun is not a firearm in Texas.
My posts on this website are worth every cent you paid me for them.

Not a firearm, but they do (unfortunately) suffer restrictions by way of "ordinance" in some cities.

Well, since there's no "explosion or burning substance" within the airgun, it would fail the test... just keep lit matches out of it I guess and you're good to go! ;-)

I've got a Chinese air rifle that tends to diesel on the first shot, so I guess it's a hybrid: a combination of compressed air, and explosion/burning.

Here is where the city of mansfield covers firearms under city ordinances

§ 130.07 NOISES DISRUPTING THE PEACE.

(13) Firearms and fireworks. The explosion of firecrackers, skyrockets, Roman candles, pinwheels or any other form of fireworks or the shooting of any firearms, air guns, pellet guns, BB guns or any other type of firearms discharge except as specifically authorized by law or the proper official.
