Lawful CHL Carry Question

Post by nemesis »

The Bossman, amongst other things, is a CHL instructor and I usually play gopher for him during training sessions. It's an opportunity to see and hear what comes into the minds of students preparing to submit a CHL application and it's often a forum for students to submit all the bad information they have regarded as gospel. Every once in a while, I hear a new one.

This one was one that we couldn't answer. At least with a straight face.

Question: "Is it legal to carry at a cockfight"?

Well, lets see. There's no PC30.06 posted and no "51" signs...........hmmmm.

Is attendance at a cockfight actually legal in Texas?

Does the promoter of the cockfight make 51% or more of his revenue through the sale of alcoholic beverages for on-premesis consumption? (Absence of a "51" sign is irrelevant . . . )

Considering the money involved, could a cockfight be considered a professional sporting event?

Attendance is not explicitly illegal. Conducting a cock fight is. So is betting.

When they bust one of these things, they get illegal drugs, weapons, public intoxication, minors in possession of alcohol, felons, illegal aliens, you name it. I'm sure they could pin something on everyone in attendence.

There is no prohibition against carry at a cockfight.

Our point of view was that he was asking if it was legal to carry a gun at an illegal event and our moral point is that it is illegal to attend an illegal event.
