Re: Sign query
I'll bet that sign is ignored most of the time. I'm sure kids eat moms take pictures a few people probably bring little dogs in and some good men carry guns. They'll string you up for smoking so the sign isn't a total loss

I might consider that a 30.05 sign which forbids me to enter carrying solicitation materials, pets, foods, smoking, taking photos, or "Firearms" which means i won't carry my concealed rifle which I usually carry in places having 30.06 (or 30.06 and 30.07 signs) ... but as a licensee to carry a handgun ... I'd carry (the concealed handgun) on since no 30.06 sign.
No defense for solicitation, smoking, pets, photos > other things on that sign ...Sec. 30.05. CRIMINAL TRESPASS. (a) A person commits an offense if the person enters or remains on or in property of another, including residential land, agricultural land, a recreational vehicle park, a building, or an aircraft or other vehicle, without effective consent and the person:
(1) had notice that the entry was forbidden; or
(2) received notice to depart but failed to do so.
(b) For purposes of this section:
(1) "Entry" means the intrusion of the entire body.
(2) "Notice" means:
(A) oral or written communication by the owner or someone with apparent authority to act for the owner;
(B) fencing or other enclosure obviously designed to exclude intruders or to contain livestock;
(C) a sign or signs posted on the property or at the entrance to the building, reasonably likely to come to the attention of intruders, indicating that entry is forbidden;
............................................
(f) It is a defense to prosecution under this section that:
(1) the basis on which entry on the property or land or in the building was forbidden is that entry with a handgun was forbidden; and
(2) the person was carrying a concealed handgun and a license issued under Subchapter H, Chapter 411, Government Code, to carry a concealed handgun.[/color]
Note this is only a defense to prosecution for carrying a handgun for a handgun licensee or if you open carry and are arrested for failing to depart (failed to depart after receiving notice), you'll have a defense. It is not an exception nor exemption. so Concealed carry of your handgun would be wisest choice here. if you conceal carry a rifle and are discovered there is no defense, same as if you walk in with a cup of coffee/start photographing stuff/take a pet in/ light a cigar/ etc and are trespassing after seeing that sign and fail to depart,
