HB 1893 and private schools

Post by LedJedi »

I quickly skimmed over HB 1893 and didn't find the answer to this so i'm gonna bounce it off you folks.

I work at a private college university. Does HB 1893 have an effect on me being able to carry concealed on campus if it passes into law? It's not a publicly funded university and receives no state funds.

The original version of the bill would not have differentiated between public and private. The version approved by the house committee would allow private universities to "opt-out" of the provision.

In the original bill could a private school have posted 30.06 signs?

Sure they could, but they wouldn't be enforceable. Just like Plano ISD has their 30.06 signs posted on their entrances that meet the specifications, but are not valid. Some of the schools have them in their entrances too. They don't need to post them there, but it serves as a reminder to not carry into the school. :thumbs2:

Not from my reading, but of course, there's the infamous disclaimer "IANAL".

If they modify 46.03 to provide an exemption for CHL (or remove schools from 46.03) I don't see why that would affect the ability of a private school to post 30.06 like any other private business.

On the other hand, if the final bill gives affirmative permission to carry at schools, that might override 30.06 trespass.
