SEGUIN — A pair of local residents have been indicted on attempted murder charges in connection with the March 9 beating of a Seguin man in which authorities say the victim lost an eye.

[Destini] Wooster and [Aurora] Herrera were booked on allegations of aggravated assault with a deadly weapon and are being held in lieu of $80,000 bail.

The victim, who was flown to University Hospital with major face and head injuries, has reportedly suffered partial paralysis and was originally listed in critical condition.

ELB,

Neither article mentioned motive. Believe me, I'm not trying to imply that the people who were attacked "asked for it" or were to blame in any way, just trying to understand why/how these things came about.

If these were attacks on strangers they are more frightening than if the attackers and victims knew each other and had some prior history of conflict. If I anger someone I can either avoid that person or try to make amends. If someone I do not know and have not had any dealings with attacks me out of the blue, that's scarier.

I don't know any of these people, nor have I heard anything other than what is in the newspaper.

I suspect that at least in the second article, someone was trying to "send a message" or take revenge. According to a different article not linked above, the gal with the gun fired it as she was leaving in a car. Overall it sounds like intimidation/threat.

Me, I would find being attacked by someone I know "scarier" because I am less likely to be on guard. I think most people are naturally warier of strangers. But if you know people who regularly resort to illegal activity and violence (e.g. drug dealers, criminals,) I suppose that might reverse the perspective. To each his own goblins. ;-)

In any case, the reason I posted this was not about the motives, it was about the results. The question of "Can I legally shoot someone who is attacking me without a gun (or without weapon?) comes up regularly, and "disparity of force" is usually the answer. These were both 2 v 1, same sex attackers/victim. Number 2 was aided by the presence of a gun (apparently) but the injuries were delivered with hands, and possibly brass knuckles and pistol-whipping.

Ouch.

I've thought long and hard about this. It is ONLY my opinion. As always, I am not a lawyer.

1. 2 on one attack. I'm being attacked by 2 people. YES! There is a disparity of force. No question about it. Those 2 combined are stronger than I. Much stronger.

2. Those 2 have a gun, or brass knuckles, or a club, a knife, or any other item which I would consider capable of killing me.

Yes of course I would use any means necessary to defend my life, and I guarantee you that any of the above 2 scenarios would I believe that I would be justified in defending my life, by what ever means necessary, including the use of deadly force.
That is my opinion.
