The way I was told by the loss prevention people was that if they just wanted to check your receipt for the hell of it they have no right to stop you.

But at a store like sams you're obligated to stop because you signed a contract saying that you would do so, not sure what effect that has on the law.

OK, am i the only one confused now? so can we verbally disclose to a non LEO if needed or do we just tell them to call the real LEO? Or do we just call the store manager and tell them? Wow, I didnt know that laws could be so tough to understand. thanks

You are not obligated to stop there either, but they could revoke your membership.

Thats why my wife hates shopping at Fryes with me. I refuse to stop.
I always carry at Frys. I remember one time a security guy at the door was giving me a look like he wanted to search me (I had no store bags) and I gave him back a look like "DON'T EVEN THINK ABOUT IT!" He let me pass.
I love reading these threads, I think I get more education by watching people debate this stuff than about anything else.

I've been to frys with my bag and someone actually went, "SIR, CAN I CHECK YOUR RECIEPT?"
I answered, "Nope!" and kept walking.
My fiancee would have been mortified if she had been with me :roll:

My response to a security guard asking me what that bulge is?

"It's my colostomy bag, and I'm very shy about it." If he takes it any further I just walk away. If he tries to stop me I tell him I'll charge him with unlawful restraint if he tries anymore. Anything past that I'll call the cops myself on my cell phone. Will he even get charged, or even convicted of unlawful restraint? Who really knows, every situation is different. Will it probably make his at least stop and think about what he is doing? Probably so. Once again as I'm saying this I'm letting him see me dial numbers on my phone, and I'm walking away. I worked in retail and it was their STRICT policy to not detain anyone even if we knew beyond the shadow of a doubt that they stole. Now if we ask them to stay and they do fine, but if we ask and they say no, we say ok. I have never met anyone who worked in retail who's policy was otherwise. JC Penny used to have a pretty aggresive policy about chasing down suspected shoplifters, but have since completely changed and no longer chase outside the store or try to restrain. Bottom line for me is I don't stop just keep walking like I never heard them. If they want to call the cops let them, it will much easier to explain to them.

I worked my days off (from LEO) in JC Penny's. That is exactly what we was told to do - chase them down.

This was relayed to me by a guy who did it as a civilian loss prevention type guy.
