Man I sure hope they are wrong but this morning Austin newspaper indicated that he had a "permit" to carry a concealed handgun.

Sorry, Kevin, I wasn't paying enough attention to the license. It is for on premises consumption or off. In this case, lawful container means the original factory packaging and it must be sealed. The trick is that you can open a larger pack to sell as singles legally, but you cannot re-package from one to another.. In other words, if two singles were pulled out of two different six packs, you cannot break another out of one to refill the second six pack.

And you raised an interesting point I had not thought of. I don't know how we determine how much of the beer was sold to go and how much for on premise consumption. It could be enough to lower it below the 51% limit. I will have to check with one of our auditors or field agents and see what they think on it.

And to all who are interested:

The article in today's Austin Statesman said that Shaver had a CHL. This contradicts the charge from the other paper of unlawfully carrying. We definitely have a lack of facts now. Of course, there was also the disputed story of who started the fight and who left the bar first to avoid it. And it turns out that Shaver's wife is related to the shooting victim (widow of victim's brother or something similar). Verrry Interesting, as Arte Johnson used to say.

So, unless Shaver had reviewed the books, he could not "know" if the place was a "bar" or not. IF less than 51% of the income, AS DETERMINED BY TABC, was for "on-premise" consumption, then the place is not a "bar", even if it has "saloon" in it's name. And if the case goes anywhere, I'm sure that Joe Turner, one of the best lawyers in Austin, will have the jury so confused that they will not be able to tell the difference between this place and a church.
